To be honest, after the office of the Vice President, the average American citizen has no idea of the legal order of succession to fill a vacancy in the Office of President of the United States – or even where to find that order of succession?

Under ordinary circumstances, the Constitution of the United States provides guidance for filling a vacated Presidency. Our Founding Fathers established the initial guidance for Removal, Death, Resignation, or Inability to discharge the Power and Duties of said Office in Article I, Section 1, Paragraph 6. Constitutionally, adjustments to the document with regard to the Presidential succession process were set in place, January 1933, with the ratification of the 20th Amendment; and again, in February 1967, with the ratification of the 25th Amendment.

However; the guidance provided within the text of the Constitution, or the Amendments, do not account for a succession path when the President is determined to be mentally unfit to fulfill the duties of the Office, and the Office of the Vice President is vacant. Fortunately, the Founding Fathers provided a legal loophole within Paragraph 6 by authorizing the Congress to fine tune the law for such a scenario.

The most recent law addressing Presidential succession is contained in Title 3, Chapter 1, Section 19 of the U S Code. The first paragraph of Section 19 provides legal guidance and an order of succession for filling the Office of President when both the Office of President and the Office of Vice President are vacant – or individuals holdings said offices are unable to discharge the powers and duties of the Office of President.

Therefore; with President Boles being deemed incapable of preforming his duties and with the office of the Vice President vacant; Title 3, Chapter 1, Section 19 of the U S Code was ruled to hold precedence over guidance established in the 25th Amendment of the U S Constitution by the Supreme Court in their recent Camp David decision. . .
