An unconfirmed report of an averted constitutional crisis, just hours before President Ahmed’s inauguration ceremony, is circulating within the inner circles of the nation’s capital .   The unnamed source, said to be a high ranking senior official from former President Coleman’s administration, told of an unprecedented, top secret meeting, held at Camp David.  Alleged participants were all nine members of the Supreme Court, the Senate Majority Leader (Kelly Hutchinson), Senate Minority Leader (Linda Adar), the Speaker of the House (Halima Ahmed), the House Minority leader (Joe Dean Malloy), and Clifton Barnes  – Chief of Staff  for both former President Colman and current President Boles.

The emergency session convened when word leaked that Barnes was attempting to push through an Urgent National Security Executive Order. The order would have designated by Presidential decree that Secretary of State Hughes Lawrence be appointed to fill the Office of Vice President – without going through the Congressional confirmation process as specified by law.   Had Barnes successfully pulled off the questionable maneuver, Boles had agreed to immediately resign his office; and Lawrence would have been sworn in as President.  The entire process was to have been carried out in secret; and announced to the nation, once the scheme had been pulled off and senior congressional officials informed.

Barnes reasoned with Lawrence firmly in place as the President; any individual or group challenging the Constitutionality of the unorthodox transfer of power would be forced to go through the Courts to contest the legality of the exploit; a legal nightmare on which it would take months, perhaps years, to reach a final decision.  Regardless of the legality, the maneuver would keep the Socialist Reform Party from gaining total control of the Federal Government by allowing the Federalist Libertarian Party to maintain control of the Presidency and Executive Branch.

The source contended Joe Dean Malloy learned of the Barnes power grab through a low level Administrative worker.  And citing the nation’s interest over that of maintaining political control of the Executive Office, Malloy apprised Hutchinson, Adar, and Ahmed of the rumor. As a result, the Camp David conference quickly pulled together.

Once the group had convened, the Supreme Court judges met in private to determine the legitimacy and constitutionality of the impromptu court assembly.  Their initial concern – could the Supreme Court convene to hear arguments from senior members of the Legislative Branch against an action executed by the Executive Branch – even before the action, in question, had even been executed?   

After thirteen hours of debate, the Court ruled unanimously that its members were acting within their Constitutional authority to hear arguments, convene in private to debate the issues surrounding the dispute, and render an immediate and Constitutionality binding judgement.

The Court convened, heard arguments, and concluded:

1. Chief of Staff Clifton Barnes had assumed duties solely designated to the holder of the Office of the President; and in doing so, had acted outside his authority by attempting to execute an Executive Order on his own authority.

2. Additionally, the President does not have the authority to appoint a Vise Presidential replacement solely by Executive Order. Any nominee considered to fill the Office of of Vise President by special appointment must be properly vetted and approved through Congressional confirmation.

3. Additionally, as a result of documented unorthodox behavioral patterns and mental instability on the part of President Boles; the Court declared the nation’s current President to be mentally and medically incapable of fulfilling his assigned Constitutional duties as President of the United States. Though not authorized to initiate any administrative action, the Court strongly urged the Congress to follow guidance as laid out in Title 3, Chapter 1, Section 19 of the U.S. code. The directive lays out the orderly removal of a sitting President, when the Office of the Vice President is vacant.
